You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is intended for use by licensed real estate professionals and individuals in the real estate industry.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@therealestatetoolbox.com if you suspect unauthorized access to your account.
Each account is for a single user. You may not share your account credentials with others or create multiple accounts to circumvent usage limits.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, abuse of the Service, or any other reason at our discretion. You may also delete your account at any time by contacting us.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
The Service uses artificial intelligence to generate listing descriptions, marketing copy, market analyses, neighborhood reports, and other content. AI-generated content may contain errors, inaccuracies, or outdated information. You are solely responsible for reviewing, verifying, and editing all AI-generated content before using it professionally or sharing it with clients.
By using AI-generated content in your professional practice, you assume full responsibility for its accuracy and appropriateness. The Real Estate Toolbox is not liable for any consequences arising from the use of AI-generated content, including misrepresentations in listings, marketing materials, or client communications.
You retain ownership of any data or content you submit to the Service (e.g., property addresses, listing details). By submitting content, you grant us a limited license to process it solely for the purpose of delivering the Service to you. We do not claim ownership of your content.
The Service, including its design, software, features, and branding, is owned by The Real Estate Toolbox and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or brand elements without our prior written consent.
The AI-generated outputs produced by the Service are provided to you for your personal and professional use. We do not claim ownership of outputs generated specifically from your inputs.
During the early access period, the Service is provided free of charge subject to usage limits (currently 300 AI requests per month per account). We reserve the right to modify these limits at any time. Exceeding limits will temporarily restrict access to AI tools until the next billing cycle. We reserve the right to introduce paid plans in the future with advance notice.
The Service is currently in an early access stage. This means features may change, be added, or be removed without notice. You may encounter bugs, downtime, or unexpected behavior. We make no guarantees about the availability, stability, or feature completeness of the Service during this period.
Your feedback during early access is valuable to us. By using the Service, you understand and accept the nature of early access software.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
WE DO NOT PROVIDE LEGAL, FINANCIAL, OR REAL ESTATE ADVICE. NOTHING IN THE SERVICE CONSTITUTES PROFESSIONAL ADVICE. ALWAYS VERIFY AI-GENERATED CONTENT AND CONSULT QUALIFIED PROFESSIONALS AS APPROPRIATE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE REAL ESTATE TOOLBOX AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $10 USD.
You agree to indemnify, defend, and hold harmless The Real Estate Toolbox and its owners, employees, and agents from any claims, damages, liabilities, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
The Service relies on third-party services including Supabase, Anthropic, Replicate, Rentcast, Resend, and Stripe. We are not responsible for the availability, accuracy, or conduct of these third-party services. Your use of the Service is subject to the terms and policies of these providers.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. For material changes, we will notify you by email at least 7 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the applicable courts of the United States.
